Terms of Service

These Terms of Service ("Terms") govern your access to and use of winlixnz.com and related services (the "Service") operated by Winlix NZ Limited ("we," "us"). By accessing or using the Service, you agree to these Terms.
1) Adult-only access
- You must be at least 20 years old and resident in New Zealand to use the Service; 20+ is our operator-set minimum entry age for social casino-style play in New Zealand.
- We may use age and identity checks and may restrict access based on location, device signals, or other compliance measures.
2) Social casino / no real-money gambling
The Service is for entertainment only. Games use virtual items and are not real-money gambling. We do not offer cash gambling, real-money wagering, or cash-out features, and we do not offer prizes of real-world value through gameplay unless explicitly stated in a separate written promotion with its own rules.
3) Accounts and security
- You are responsible for your account and all activity under it. Keep credentials confidential.
- Provide accurate information and maintain it. One account per person unless we approve otherwise.
- We may suspend or terminate accounts for suspected fraud, underage use, policy violations, or risk to the Service.
4) Acceptable use
- Do not cheat, exploit bugs, automate play (bots/scripts), or manipulate outcomes.
- Do not reverse engineer, bypass security, scrape, interfere with the Service, or use the Service to break laws.
- Do not harass, post unlawful content, infringe rights, or attempt unauthorized access to accounts or systems.
5) Virtual currency and virtual items
- Virtual currency, credits, chips, coins, boosters, and similar items ("Virtual Items") are licensed, not sold.
- Virtual Items have no cash value, are not redeemable for money, and are non-transferable unless we expressly allow it.
- We may modify, remove, reprice, limit, or discontinue Virtual Items and their availability at any time to the extent permitted by law.
- Loss of Virtual Items due to enforcement actions, expiration, or Service changes may occur where lawful.
6) In-app purchases (IAP) and payments
If the Service offers optional purchases, they are for entertainment and grant a limited license to access Virtual Items. Purchases are generally non-refundable except where required by applicable law or the applicable app store/payment provider rules. Your payment provider (e.g., Apple/Google) may apply additional terms and handle billing.
7) Intellectual property; copyright notices
The Service, including software, text, graphics, logos, and game content, is owned by us or our licensors and protected by the Copyright Act 1994 (NZ) and other intellectual property laws. You receive a personal, revocable, non-exclusive, non-transferable licence to use the Service for lawful personal entertainment. We respond to valid copyright notices and may terminate repeat infringers where appropriate.

8) Disclaimers and limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) NZ$100.
9) Governing law and dispute resolution
These Terms are governed by the laws of New Zealand, including the Gambling Act 2003, the Consumer Guarantees Act 1993, and the Fair Trading Act 1986. Contact us first at contact@winlixnz.com to try informal resolution. If a dispute is not resolved, it may be referred to the Disputes Tribunal of New Zealand (for claims within its jurisdiction) or to the courts of New Zealand, which have exclusive jurisdiction. Nothing in these Terms limits any non-excludable rights or remedies you have under the Consumer Guarantees Act 1993 or other New Zealand consumer law.
10) Termination
You may stop using the Service at any time. We may suspend or terminate access (and the license granted) at any time if we believe you violated these Terms, if required by law, or to protect the Service. Upon termination, access to the Service and Virtual Items may be lost where lawful.
11) Changes
We may update these Terms from time to time. Changes apply when posted to this page with an updated effective date. Continued use after changes means you accept the updated Terms.
